מסכת גיטין פרק ב

דף יב, א פרק ב הלכה ג גמרא  אם בא ועירר עררו קיים.  הקורע על העור כתבנית כתב כשר.  הרושם על העור כתבני' כתב פסול.  הרי זה גיטיך על מנת שתתנהו לי פסול.  ע"מ שתחזירהו לי כשר.  ולא דא היא קדמייתא.  אמר רבי יוסי לכשתדיני.  אמר רבי יוסי בי רבי בון לכשתזכה בו ובמצוותו תחזירהו לי.  כהדא תרונגא הוון מצפצפים תמן והוה רב נחמן בר יעקב יהב תרנגא מתנה לבריה ואמר ליה לכשתזכה בו ובמצוותו תחזירהו לי.  ר' ירמיה בעי כתבו על כוס של זהב ואמר לה מקום הכתב שליך ובין השיטים שלי.  ויש כתב.  עור הנקרע הרי כשר.  נתקרע הרי זה פסול.  בשלא נתקרע כקרע בית דין.  אבל נקרע כקרע בית דין.  אי זהו קרע של בית דין בין כתב לעדים.  על העלה של זית.  ולא כמקורע הוא.  אמר רבי זעירא תנא בונה בר שילא אפילו כותב אני פלוני מגרש את אשתי כשר ואתייא כיי דמר רבי אילא אם פירש פסול.  ואם לא פירש כשר.  עלה קרן של פרה.  מתני' כשאמר לה הרי גיטיך.  אבל אם אמר לה הרי גיטיך והשאר לכתובתיך נתקבלה גיטה וכתובתה כאחת.  אמר לה הרי גיטיך וכתובתך כאחת.  ר"ז בעי קומי רבי מנא מסר לה במוסירה מהו.  מידת הדין את אמר נקנה המקח והכא את אמר הכין.
